A deadly shooting in Omaha Wednesday morning has claimed the life of a five-year-old girl.

Dead is Payton Benson, shot by a stray bullet, fired from a car, intended for someone else.

Update:   Omaha Police have identified the girl as Payton Benson, DOB as 10/19/08.  Her name initially was identified as Victoria. They also now have a vehicle description and say three men are involved.  They are armed with a high powered rifle and a handgun.

Family member Massey Allen III say Payton was inside her home finishing breakfast when shots were fired from outside the home around 9:45 a.m.

Allen says he was driving home and heard about 20 gunshots. He ducked behind the steering wheel of his vehicle to protect himself. He says seconds later he saw his cousin, the mother of Victoria, outside the home near 44th and Bedford Avenue, yelling for help.

Allen says the shots fired came from individuals inside a vehicle. He says the shots were intended for someone running in the area and a stray bullet hit the child.

Allen says the victim is the niece of Omaha City Councilman Ben Gray. The shooting happened in his district.

Allen says the two moved to Omaha from Chicago three years ago. Victoria’s mother was attending nursing school.

Omaha police say the investigation is underway and there have been no arrests.
