A Kearney police officer has been charged with second degree assault for shooting and wounding a driver who fled from a traffic stop.
The Nebraska Attorney General’s office reports Officer Derek Payton was charged after an investigation by its office, the Nebraska State Patrol, and the Buffalo County Sheriff’s Office.
Payton turned himself in on Thursday afternoon. He has posted bond.
According to the Attorney General’s office, Payton tried to stop 36-year-old Jose Klich on June 5th for operating a car with the wrong license plates. Klich fled the traffic stop. Payton fired three times at the moving car, hitting the windshield on the passenger side twice, and the back window once. Klich suffered a wound to the upper right side of his abdomen. He was arrested after hitting a building in Kearney.
Klich was taken to Good Samaritan Hospital. He underwent surgery. One bullet was removed and he was released from hospital.
