42 states currently require establishments that serve alcohol to carry Dram Shop insurance. That means if they over serve someone who intends to drive, the owners and bartenders could have liability. Senator Tom Carlson of Holdredge thinks Nebraska needs such a law.
“Where there is probably gross negligence involved we need to have a way deal with that and at the same time not interfere with those doing business that do it the right way.”
Carlson agrees that there have been accidents caused by bartenders who are not responsible when serving drinks, however, he is still working on his bill to make sure that the law would not promote people filing frivilous lawsuits against bar owners.
