An unwanted kiss will remain just that, an unwanted kiss, not sexual assault.
A bill that would have added an unwanted kiss to the sexual assault statutes has been withdrawn by its sponsor, Sen. Bill Avery of Lincoln.
Avery told fellow senators during a flood speech that he submitted LB 797 after an unwanted kiss was forced upon a constituent of his by a registered sexual offender. No law exists for such an offense, so the offender spent 90 days in jail on a charge of disturbing the peace. Avery said he agreed to help the family change the law to address such situations.
“However, since submitting the bill it has been subjected to ridicule, distortion and has become fodder for political satire,” Avery stated. “This is unfair to the family and the victim who I was trying to help and has become a major distraction.”
Avery said prosecutor had also told him that it would be a difficult law to prosecute.
