An Omaha police officer fired after the violent arrest of a man that was caught on video is reinstated. After the termination of Officer Jacki Dolinski, her case was reviewed by an independent arbitrator and the president of the Omaha Police Union, John Wells says determined her use of force was justified. He says Dolinsky used an approved tactic after being kicked and grabbed by the suspect.
The man who was the subject of that arrest says he isn’t surprised. Robert Wagner’s arrest was caught on surveillance video in May of 2011 outside of Creighton University Medical Center. In that video you can see Wagner taken to the ground by several police officers. Wagner says other officers should have intervened when several went overboard. He also doesn’t blame the officers but someone should be held responsible.
Wagner ended up pleading no contest to attempted assault on a police officer and will be sentenced later this month. Prior to the plea Wagner’s trial ended in a mistrial. An arbitration hearing will be held later this summer for the second officer fired, Aaron Pennington.
