Two police officers and the City of Beatrice are being cleared of any wrongdoing in the March 2012 arrest of Timothy Fugett. He had filed suit after suffering a broken hip in the course of his arrest for a domestic incident.
Beatrice Police Chief Bruce Lang says the city felt confident the officers acted properly. Chief Lang says domestic incidents can be dangerous as people are upset and emotions run high. Lang says sometimes, defendants go after cities and police departments figuring the city has deep pockets and will settle such cases.
Officer Shane Mololey has been with the Beatrice Police Department for about five years. Officer Thomas Oelschlager is now with the Omaha Police Department.
Oelschlager was the officer that tackled Fugett as he ran toward a house, where police believed Fugett’s wife and children were hiding from him. Fugett suffered a broken hip.
Gage County District Judge Paul Korslund ruled the officers’ actions in arresting Fugett were justified, and that they did not violate Fugett’s constitutional rights.
