At a news conference, Madison County Attorney Joe Smith said there was a scuffle at the Super 8 Motel just before 7 o’clock Wednesday morning.
“An officer was involved and that officer was the one that was slightly injured in the hospital,” Smith. “The decedent was taken to the hospital. Later on, other officers responded. There was no firearms involved. There was no lethal-type force.”
Smith said the officer attempted to use a taser, but it is not known if it was deployed.
He said the officer and the suspect were taken to Faith Regional Health Services where the man died just after 8 AM Wednesday. The officer was treated for a series of injuries.
The suspect is identified as 42-year-old Andre Larone Murphy, Senior, with his last known address in Seward.
Smith says State Patrol investigators are reviewing video of the incident and they’re talking with civilian and law enforcement witnesses. He says an autopsy will be conducted in Omaha.
Because the fatality occurred during interaction with law enforcement, a grand jury will be convened to investigate.
“The grand jury will call fairly briefly,” Smith says. “The statue requires a grand jury and the statue requires that the investigation be treated as if it was a homicide investigation and that is how it has been treated.”
