A grand jury has cleared an Omaha police officer in the shooting death of a robbery suspect.
Omaha Police Officer Alvin Lugod will not be charged in the death of Danny Elrod, who he shot twice in the back.
The incident took place on February 23rd as officers responded to a call about a robbery at a Family Dollar store. Officers tracked down Elrod at a nearby parking lot. According to police reports, officers repeatedly ordered Elrod to show his hands and get on the ground. He refused.
Lugod stated he took Elrod’s action as a threat to other officers when he turned away from him and toward the other officers. Lugod fired three shots, hitting Elrod twice.
The Omaha Police Department continues an internal investigation into the fatal shooting.
The grand jury also cleared three officers involved in the fatal shooting that killed a member of the “Cops” television show during production in Omaha.
Three officers, 37-year-old Detective Darren Cunningham, 35-year-old Officer Brooks Riley, and 39-year-old Officer Jason Wilhelm will not face criminal charges in the shooting deaths of 32-year-old Cortez Washington and 38-year-old Bryce Dion.
The three opened fire in a Wendy’s restaurant in August after Washington fired a pellet gun. Dion, a sound mixer for the television crew, died from a gunshot wound in the crossfire.
