A 12 year old murder suspect being held in Minneapolis waived extradition back to Nebraska to face charges. Jerrell Milton was arrested Tuesday night and will be charged in the shooting death of a man last week in northeast Omaha.
James Martin Davis is an Omaha defense attorney and says this isn’t the first time a pre-teen has been charged with murder in the metro area. He says he defended a 12 year old charged with murder a few years ago and the case was heard in juvenile court.
Davis says juvenile court isn’t designed to convict children. He says it is designed to do what is in the child’s best interest and they can provide many services. He says if the boy is convicted he will be sentenced to the Youth Detention and Rehabilitation Center in Kearney up to the age of 21.
Milton’s 17 year old brother is charged as an adult with murder along with a 15 year old. Milton’s mother had spent time in prison for assault and his father is currently serving a murder sentence in Minnesota.
