A lawsuit has been filed against the city of Omaha in connection to the death of a member of the TV show COPS in August of 2014. The lawsuit was filed by the brother of Bryce Dion who was killed during an armed robbery shootout at Wendy’s in Omaha’s midtown area. Attorney Dave Domina is representing Dion’s family and explains why the city of Omaha is responsible for his death.
Domina says, “This gentleman and his crew were here at the invitation of the city of Omaha. At the invitation of the police chief. The purpose was to film the police department as a guest of the police department so they undertook a special and obvious responsibility to be aware of his presence, direct his deployment and to make sure that deployment was to a responsible position.”
Dion was the sound man for the TV crew and was in the entryway of Wendy’s when he was shot through a gap in his bulletproof vest. He was rushed to a hospital and later died. The lawsuit alleges that an officer arriving at the scene of the robbery was not informed that the COPS TV crew was at the scene. Dion was killed by a bullet fired by an Omaha police officer.
Officials with the City of Omaha say they are not liable for Dion’s death and plant to fight the lawsuit.
