The Department of Justice issued a federal mandate that allows transgender students to use the bathroom or locker room of the sex they identify with.
For many schools this will become policy, but Joe Herring of Omaha opposes it and is taking up the issue with the local school board.
He wrote the board a letter, along with the superintendent and principals of schools his family attends stating reality cannot be altered.
“For them to permit a male to go into a female restroom and use the facilities there without any prior restraint of whoever else might be in there in my mind equals criminal facilitation of indecent exposure,” according to Herring.
Herring says the Department of Justice calls this “guidance,” but it came with a threat that federal funding could be in jeopardy.
Herring claims that falls under the category of an unlawful order which every member of government has a duty to resist.
“If they go ahead and implement this, that has placed them on the side of criminal facilitation.”
He says when it comes to the threat of losing federal funding we should not allow ourselves to be put in a blackmail position.
Herring is encouraging Nebraskans concerned with the federal bathroom mandate to contact their local school districts with their concerns.
