A 27-year-old southeastern Nebraska man has been sentenced to jail and placed on probation for having sex with a 16-year-old co-worker.
Cody Peck of Beatrice reached a plea agreement with prosecutors and has been convicted of contributing to the delinquency of a minor.
Gage County District Judge Vicky Johnson rejected Peck’s claim he was the victim in the case.
“It is always bothersome to me when we have a sentencing and the first thing that happens is the defendant blames a 16-year-old girl when he’s 25 and has sex with her whether voluntary or not,” Johnson said during Peck’s sentencing hearing.
Prosecutors say Peck had sex with the teen-ager at his home in the summer of 2014.
Johnson told Peck he has no excuse for his actions.
“The fact of the matter is Mr. Peck that nice guys don’t have sex with 16-year-old girls when they’re 25, particularly when they’re already involved with another woman with whom you have children,” Johnson said.
Johnson has ordered Peck to begin his jail sentence immediately. He will serve one year of probation and more jail time if he violates probation.
