The son of former Nebraska Athletic Director Shawn Eichorst is out of jail after posting a percentage of the $25,000 bond. Jack Eichorst was arrested last Friday and is charged with 1st degree sexual assault. The victim is a 12 year old boy who reported the incident late last month to a school guidance counselor.
In a statement from Eichorst’s attorney it stated that the 18 year old has autism. Records show that Eichorst had electronic communication with the victim and had apologized.
Omaha Defense Attorney James Martin Davis says conditions like mental health do come into play in the courtroom.
Davis says, “Your job is not just to get him off. Your job is to do what is in his best interests and to try to find out what motivated him to do it and see if there are any mitigating circumstances that caused him to get involved in this kind of conduct.”
Davis says several factors come into play during sentencing and that includes mental health and age of the perpetrator. Davis is not the Eichorst’s attorney.
Eichorst’s preliminary hearing is set for November 17th.
