ACLU of Nebraska has filed a lawsuit over the state’s death penalty.
The group maintains the eleven men on death row should have had their penalties converted to life in prison by the governor between passage of the repeal bill and before voters reinstated the penalty through a referendum vote.
The ACLU argues the reinstatement of the death penalty only applies to future crimes.
The lawsuit also states Governor Pete Ricketts violated the state Constitution’s separation of powers clause.
The ACLU claims Ricketts proposed, initiated, funded, organized, operated and controlled the campaign to gather signatures and promote the effort.
